ເງື່ອນໄຂການໃຊ້ບໍລິການ ຕະຫຼາດແລກປ່ຽນເງິນຕາຕ່າງປະເທດລາວ (LFX)

ຜູ້ໃຊ້ບໍລິການຮັບຊາບ, ຍິນຍອມ ແລະ ຕົກລົງເຫັນດີຕໍ່ກັບເງື່ອນໄຂການໃຊ້ບໍລິການ, ການເຂົ້າເຖິງ ແລະ ແລະ ການຄຸ້ມຄອງລະບົບ LFX ກັບ ບໍລິສັດ ຕລຕ ດັ່ງນີ້:

1. ເງື່ອນໄຂໃນການໃຊ້ບໍລິການ ຕະຫຼາດແລກປ່ຽນເງິນຕາຕ່າງປະເທດລາວ

  • ຜູ້ໃຊ້ບໍລິການ ຕົກລົງວ່າ ການດໍາເນີນງານໃດໆໃນການເຂົ້າລະບົບໃຫ້ບໍລິການແລກປ່ຽນເງິນຕາຕ່າງປະເທດລາວ (LFX) ທີ່ໃຊ້ User ID, ລະຫັດລັບ ແລະ ຜ່ານການຢືນຢັນຕົວຕົນ ຜູ້ໃຊ້ງານແມ່ນໄດ້ປະຕິບັດຖືກຕ້ອງຕາມລະບຽບການ ແລະ ລະບົບຄວາມປອດໄພຂອງ ທະນາຄານຜູ້ໃຫ້ບໍລິການວາງອອກ;

  • ຜູ້ໃຊ້ບໍລິການຕ້ອງມີຄວາມສາມາດທາງດ້ານການເງິນ, ໃຊ້ບໍລິການ LFX ຢ່າງຖືກຕ້ອງຕາມເງື່ອນໄຂຕ່າງໆທີ່ໄດ້ກຳນົດໄວ້ ດ້ວຍຄວາມສະໝັກໃຈ ແລະ ມີຄວາມຮັບຜິດຊອບ;

  • ຜູ້ໃຊ້ບໍລິການຕ້ອງດຳເນີນທຸລະກຳຜ່ານ LFX ຢ່າງຖືກຕ້ອງຕາມກົດໝາຍ ແລະ ລະບຽບທີ່ກ່ຽວຂ້ອງຂອງ ສປປ ລາວ, ລວມທັງຂໍ້ກໍານົດດ້ານການເງິນ, ການປ້ອງກັນການຟອກເງິນ ແລະ ມາດຕະຖານການຊຳລະສະສາງສາກົນ;

  • ຜູ້ໃຊ້ບໍລິການ ຕ້ອງມີບັນຊີເງິນກີບ ແລະ ສະກຸນເງິນຕາຕ່າງປະເທດ ທີ່ຕ້ອງການຊື້ ຫຼື ຂາຍ;

  • ຜູ້ໃຊ້ບໍລິການລະບົບ LFX ຕ້ອງດຳເນີນທຸລະກຳໃນຂອບເຂດທີ່ກຳນົດ, ປະຕິບັດຕາມວົງເງິນ, ຂອບອັດຕາແລກປ່ຽນ ແລະ ລະບຽບການທີ່ກ່ຽວຂ້ອງ;

  • ຜູ້ໃຊ້ບໍລິການ ຍອມຮັບ ແລະ ຮັບຮູ້ການປ່ຽນແປງລະບຽບການ, ເງື່ອນໄຂ ແລະ ຄ່າທຳນຽມໃນການໃຊ້ບໍລິການຂອງ LFX ທີ່ ບໍລິສັດ ຕລຕ ປະກາດໃຊ້ໃນແຕ່ລະໄລຍະ.

2. ຂໍ້ຫ້າມ

  • ຫ້າມຜູ້ໃຊ້ບໍລິການ ມີພຶດຕິກໍາສວຍໃຊ້ການບໍລິການຂອງ ບໍລິສັດ ຕລຕ ເຂົ້າໃນການເຄື່ອນໄຫວທີ່ບໍ່ຖືກຕ້ອງຕາມກົດໝາຍ ເຊັ່ນ: ການຟອກເງິນ, ການຫຼອກລວງ ຫຼື ການເຄື່ອນໄຫວນອກວັດຖຸປະສົງອື່ນໆ ທີ່ອາດເຮັດໃຫ້ເກີດຄວາມເສຍຫາຍ ຕໍ່ ບຸກຄົນ, ນິຕິບຸກຄົນອື່ນ ແລະ ຊື່ສຽງຂອງ LFX;

  • ຫ້າມຜູ້ໃຊ້ບໍລິການ ມີພຶດຕິກໍາສົ່ງຄໍາສັ່ງຊື້ ຫຼື ຂາຍ ທີ່ອາດຈະເຮັດໃຫ້ອັດຕາແລກປ່ຽນຜັນຜວນແຮງຢ່າງຜິດປົກກະຕິ ເຮັດໃຫ້ເກີດຄວາມເສຍຫາຍ ຕໍ່ການດໍາເນີນງານຂອງຕະຫຼາດ LFX;

  • ຫ້າມຜູ້ໃຊ້ບໍລິການ ມີພຶດຕິກໍາໃສ່ຮ້າຍປ້າຍສີຕໍ່ຜູ້ໃຫ້ບໍລິການ ຫຼື ຜູ້ເຂົ້າຮ່ວມວຽກງານດັ່ງກ່າວ;

  • ຫ້າມຜູ້ໃຊ້ບໍລິການ ມີພຶດຕິກໍຳອື່ນທີ່ເປັນການລະເມີດກົດໝາຍ ແລະ ລະບຽບການ ທີ່ກ່ຽວຂ້ອງ;

3. ມາດຕະການຕໍ່ຜູ້ລະເມີດ

  • ບໍລິສັດ ຕລຕ ຈະຮ່ວມມືກັບທະນາຄານແຫ່ງ ສປປ ລາວ (BOL) ແລະ ເຈົ້າໜ້າທີ່ທີ່ກ່ຽວຂ້ອງໃນການກວດກາ ຖ້າພົບເຫັນທຸລະກຳທີ່ບໍ່ສອດຄ່ອງ ຫຼື ບໍ່ຖືກຕ້ອງຕາມລະບຽບກົດໝາຍທີ່ກ່ຽວຂ້ອງກຳນົດໄວ້;

  • ຜູ້ໃຊ້ບໍລິການ ທີ່ລະເມີດເງື່ອນໄຂ ແລະ ຂໍ້ຫ້າມທີ່ໄດ້ກຳນົດໄວ້ຂ້າງເທິງ ແລະ ລະບຽບການກ່ຽວຂ້ອງທີ່ບໍລິສັດ ຕລຕ ກຳນົດໄວ້ເປັນ ຈະຖືກດໍາເນີນ ໜຶ່ງ ຫຼື ຫຼາຍມາດຕະການດັ່ງນີ້:

  • ສຶກສາອົບຮົມ ແລະ ກ່າວເຕືອນປາກເປົ່າຜ່ານໂທລະສັບ;

  • ກ່າວເຕືອນຢ່າງເປັນລາຍລັກອັກສອນ (ໂຈະການເຄື່ອນໄຫວ User ID ຊົ່ວຄາວ);

  • ປິດບັນຊີຜູ້ໃຊ້ຖາວອນ;

  • ຮັບຜິດຊອບໃຊ້ແທນຕາມມູນຄ່າຄວາມເສຍຫາຍທີ່ຕົນເອງໄດ້ກໍ່ຂຶ້ນ ກໍລະນີສ້າງຄວາມເສຍຫາຍທາງແພ່ງໃຫ້ແກ່ ບຸກຄົນ, ນິຕິບຸກຄົນ, ບໍລິສັດ ຕລຕ ຫຼື ການຈັດຕັ້ງອື່ນ;

  • ຖືກດໍາເນີນຄະດີອາຍາຕາມກົດໝາຍ ແລະ ລະບຽບການທີ່ກ່ຽວຂ້ອງ ຕາມກໍລະນີເບົາ ຫຼື ໜັກ ກໍລະນີເປັນການປະທໍາຜິດທາງອາຍາ.

Terms and Conditions of  Using for Lao Foreign Exchange (LFX)

The user acknowledges, agrees to, and accepts the terms and conditions governing the use, access, and protection of the LFX system, as provided by the Lao Foreign Exchange Company, as follows:

  1. Conditions for Using Lao Foreign Exchange

  • The user agrees that any operation accessing the Lao Foreign Exchange (LFX) system using a User ID, password, and identity verification shall be considered valid and in compliance with the regulations and security standards established by the service-providing bank.

  • The user must have sufficient financial capacity and use the LFX services in full compliance with the prescribed conditions, voluntarily and with full responsibility.

  • The user will conduct transactions through the LFX system strictly in accordance with the laws and applicable regulations of the Lao PDR, including, but not limited to, financial regulations, anti-money laundering requirements, and international settlement standards.

  • The user must maintain an account in Kip as well as in the relevant foreign currency intended for purchase or sale.

  • Users of the LFX system shall conduct transactions within the prescribed scope, adhering to transaction limits, exchange rate ranges, and all other applicable regulations.

  • The user acknowledges and accepts any amendments to the regulations, terms, and service fees of LFX as officially announced by the Lao Foreign Exchange Company from.

​2. Prohibitions

  • The use of this product as a tool for market speculation, which may cause exchange rate volatility, is strictly prohibited.

  • Refusal to cooperate with inspections conducted by the Bank of the Lao PDR and other competent authorities is strictly prohibited.

  • Users are prohibited from misusing LFX services for unlawful activities, including money laundering, fraud, or any other unauthorized actions that may harm individuals, legal entities, or the reputation of LFX.

  • Users are prohibited from placing buy or sell orders that may cause abnormal or excessive volatility in the exchange rate, potentially disrupting LFX's operations.

  • Users are prohibited from engaging in defamation or disparagement of the service provider or other participants.

  • Users are prohibited from engaging in any conduct that violates applicable laws or regulations.

3. Measures Against Violators

  • The Lao Foreign Exchange Market Company shall cooperate with the Bank of the Lao P.D.R. (BOL) and other relevant authorities in conducting inspections. If any transaction is found to be inconsistent with or in violation of applicable laws and regulations, appropriate measures will be taken.

  • Any user who violates the terms, prohibitions, or regulations established by the Lao Foreign Exchange Market Company shall be subject to one or more of the following measures:

  • Education, training, and a verbal warning delivered by telephone.

  • Written warning, which may include the temporary suspension of the User ID).

  • Permanent termination of the user’s account.

  • Liability for compensating damages caused by the user in cases where civil harm is inflicted on an individual, a legal entity, the Lao Foreign Exchange Market Company, or any other organization.

  •  Criminal prosecution under the applicable laws and regulations, whether for minor or serious offenses, which shall be considered criminal acts.
